Act on the production, sale, and handling of cannabis products

Act on the production, sale, and handling of cannabis products

Art. 1
Aim of the Act

The aim of this act is to reduce harm inflicted by cannabis, increase public health, reduce addiction related crimes, the abolishment of punishment for certain mind altering substances, increase safety and protection of the rights of users, the protection of children and youth and collection of revenue for the Treasury.

Art. 2
Definitions

Cannabis in this Act is defined as any product which contains Tetrahydrocannabinol (THC), including marijuana, hash and cannabis oil.

Art. 3
Production

Anyone who has reached 20 years of age may grow and produce cannabis for their personal use.

The Minister issues permits for the growth and production of cannabis products for general consumption. Only those who have reached the age of 20 may work in the production of cannabis products.

The Minister may issue a Regulation which stipulates further rules regarding the production of cannabis products in a regulation.

Art. 4
Age limits

It is not permitted to sell or give cannabis products to an individual who has not reached 20 years of age.

Cannabis in the possession of those who have not reached 20 years of age may be seized.

Art. 5
Sale

It is permitted to operate stores with cannabis products and products related to their consumption and manufacturing. Municipalities issue permits for the operation of stores in line with the first sentence of this article. Those who serve cannabis in such stores shall have reached 20 years of age. The Minister may enact further rules on the operation of such stores. Municipalities may stipulate additional conditions related to opening hours, the availability of other products and the proximity of the stores to other services. Consumption of cannabis is prohibited in stores operating under the conditions of this article.

Art. 6
Catering

The operation of cannabis restaurants is permitted. Licensing of such operations is governed by Class II of Article 4, Paragraph 3 of the Act on Restaurants, Accommodation, and Entertainments, no. 85/2007. Municipalities may stipulate additional conditions on opening hours and the proximity of the restaurants to other services. Cannabis sold in restaurants operating according to this Article is intended for consumption on site. A licence for distribution of alcohol in cannabis restaurants is prohibited.

Art. 7
Labeling

All cannabis products, whether sold in retail facilities or restaurants, shall contain information about the products’s THC proportion. Cannabis products, sold in retail facilities shall have plane gray packaging, labeled with black text on a white background, providing the name of the manufacturer, the name of the product, and the product type, detailed description of contents, and warning about the health hazards of cannabis consumption.

The Minister may enact further rules for the implementation of this Article.

Art. 8
Advertisements

Advertising of cannabis products is prohibited. Same applies to instruments and raw materials intended for the consumption and production of cannabis products. Encouraging cannabis consumption in advertisement is prohibited.

Art. 9
Cannabis fee

A special fee shall be paid to the Treasury for all cannabis products produced in Iceland or imported into the country.

The amount shall be ISK 2,000 per gram of THC.

In other respects the same law shall apply to the collection of cannabis fee as for the collection of alcohol fees, in accordance with the Act on Alcohol and Tobacco Fees, no. 96/1996.

The Minister may enact further rules on the collection of a cannabis fee.

Art. 10
Sanctions

Violation of Art. 3 is subject to fines.

Violation of Art. 4 – 6 is subject to fines and suspension of operating license.

Violation of Art. 7 is subject to fines.

Violation of Art. 8 is subject to fines.

Violation of Art 9 is subject to fines.

Art. 11
Enter into force

This Act shall enter into force on 1 July 2018.

Art. 12

Upon entry into force of this Act, the Act on drugs and narcotic substances, no. 65/1974, will be amended in the following manner: The words “Cannabis (Kannabis, Marihuana, Hass)” and the words “Cannabis harpix” in Art. 6 will be omitted.
